1. Agreement to Terms

These Terms govern use of www.phyrno.com, Early Access registration, and related website features offered by Phyrno. If Phyrno later provides beta or software access, supplemental terms may apply.

2. Who Phyrno Is

In these Terms, Phyrno, we, us, and our means the operator of the Phyrno website and brand.

3. Eligibility

The site is not intended for children under 13. Users under the age of legal majority where they live should use the site with the involvement or permission of a parent or legal guardian where required.

4. Early Access

Joining Early Access expresses interest only.

• It does not guarantee beta access, timing, or eligibility.
• It does not create a purchase.
• It does not guarantee features or pricing.

Phyrno may invite users in stages, change the beta program, limit participation, or suspend or end Early Access.

5. Beta / Pre-Release Software

If Phyrno later provides beta or pre-release software, it may be incomplete, contain bugs or errors, change over time, or become unavailable.

You should maintain backups of important source recordings and should not rely on Phyrno as the sole copy of important media.

6. Creator Intelligence / Recommendations

Any analytics, performance insights, recommendations, predictions, content suggestions, or game/session suggestions are informational tools only.

They do not guarantee views, watch time, subscriber growth, audience growth, monetization, revenue, sponsorships, or platform success. Creators remain responsible for their own content and publishing decisions.

7. Acceptable Use

You may not use the site to:

• Violate applicable law.
• Interfere with the website or its security.
• Attempt unauthorized access to systems or data.
• Introduce malware or harmful code.
• Abuse forms or APIs.
• Scrape or automate access in ways that harm the service.
• Impersonate others or violate third-party rights.

8. Intellectual Property

Phyrno and the website materials, branding, software, interface designs, graphics, logos, and related intellectual property are owned by or licensed to Phyrno and are protected by applicable law.

You receive a limited right to access and use the public website for its intended purpose.

9. User Content

The current website does not provide gameplay upload functionality. If future Phyrno software allows users to import, upload, process, or create content, users retain rights in their content, subject to additional product or beta terms needed for Phyrno to provide those functions.

10. Feedback

If you voluntarily share ideas, suggestions, or feedback, Phyrno may use that feedback to develop and improve services without restriction or compensation, provided this does not transfer ownership of unrelated user content.

11. Third-Party Services and Links

Phyrno may rely on or link to third-party services, including YouTube, Vercel, and Supabase. Third-party services are governed by their own terms and policies.

12. Changes / Availability

Phyrno is under active development. Features, content, availability, and Early Access may change, and we may modify, suspend, or discontinue website features where reasonably necessary.

13. Disclaimers

To the maximum extent permitted by law, the website and Early Access are provided as is and as available. Phyrno does not warrant uninterrupted or error-free operation, and does not warrant that every planned feature will launch.

14. Limitation of Liability

To the maximum extent permitted by law, Phyrno will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or Early Access.

To the maximum extent permitted by law, the aggregate liability of Phyrno arising from the website or Early Access will not exceed the greater of: (a) the amount you paid Phyrno for the relevant service during the 12 months before the claim, or (b) $100 USD.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-laws principles, to the extent permitted by applicable law.

Disputes will be resolved in courts of competent jurisdiction located in North Carolina, United States.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent legally permitted.

17. Changes to Terms

Phyrno may update these Terms as services evolve. We will update the Last updated date and may provide additional notice where appropriate.
